Peru: Congress considers curbing the increase in excise taxes on virtual sports betting

(Lima).- Legislators are seeking to urgently approve a rule limiting the Selective Consumption Tax on online gambling platforms, following the economic impact on users and operators.

The Peruvian Congress is debating the approval of a law limiting the collection of the Selective Consumption Tax (ISC) on virtual sports betting, a measure that currently represents a significant additional cost for users and operators in the sector.
The origin of the conflict dates back to Legislative Decree 1644 of the Ministry of Economy and Finance (MEF), which established that online sports betting—including those of foreign companies not domiciled in Peru—must pay ISC. However, the tax was passed directly on to the end consumer, generating unrest and discontent in the industry.
In June, Congress approved a bill amending the tax and also penalizing the manipulation of sports results. However, the Executive branch rejected the initiative, considering that "there is no legal loophole" in the regulation for foreign platforms.
Experts such as former Constitutional Court President Carlos Mesías maintain that the law was "poorly conceived" and warn that operators could take the tax collection to court, which would jeopardize millions of soles already collected.
The future of online sports betting in Peru will be decided in Parliament. If the law is passed through insistence, users and operators would have a respite. Otherwise, the issue could end up in court, creating an uncertain future for a rapidly expanding industry.
